Comfort Posture Buyer Protection – “Money Back Guarantee”
These Terms and Conditions apply to the “Comfort Posture Buyer Protection,” which offers a money-back guarantee if the buyer is not satisfied with the product or if the product is not delivered as agreed.
Promoter: The entity responsible for Comfort Posture Buyer Protection is CP AUS.
Eligible Buyer: To be an eligible buyer, you must be a registered member on our website and have successfully made a purchase of goods and/or services offered at Comfort Posture.
Buyer Protection Period: The protection period is the number of days (confirmed on the product page at the time of purchase) in which the seller guarantees that you will receive the product or service purchased. This period starts from the day the purchase is completed.
Rules: a. If you do not receive the products within the Buyer Protection period or receive products that you deem to be substandard, you may initiate a dispute process.
b. During the dispute process, our team will investigate the case, considering but not limited to the following factors: i. Whether the products received are damaged, defective, or significantly different from what was presented on the product page; ii. Whether the non-receipt of the product was due to factors beyond the control of the buyer or seller; iii. Whether there was an error or miscommunication on the part of the buyer, such as providing an incorrect shipping address; iv. Whether the products were returned due to customs clearance issues.
c. We may request information, documents, and evidence to support your claim.
d. After the dispute process, a final determination will be made. If the decision is in favor of the buyer, a refund will be processed within 15 days of the completion of the dispute. The refund will generally be made using the same payment method used for the purchase, unless otherwise agreed.
General Rules: a. By participating in Comfort Posture Buyer Protection, you agree to be bound by these Terms and Conditions.
b. Any fraud or abuse by the buyer will result in forfeiture of eligibility under these Terms and Conditions.
c. We are not responsible for delays, losses, or misdirected deliveries caused by incorrect information provided by the buyer.
d. The eligibility for Buyer Protection will be determined by CP AUS, and our decision will be final.
e. We reserve the right to modify these Terms and Conditions without prior notice. In the event of disputes, our decision will be final and binding.
Force Majeure: We shall not be held liable for any failure to fulfill these Terms due to causes beyond our control, including Internet failures, telecommunications issues, strikes, wars, natural disasters, and others.
Dispute Resolution: a. In case of any discrepancy between the English version and other translated versions of these Terms and Conditions, the English version shall prevail.
b. In the event of conflict between these Terms and other site rules or information, these Terms and Conditions will take precedence.
Disclaimer: To the fullest extent permitted by law, we shall not be liable for any direct or indirect damages arising from your participation in Comfort Posture Buyer Protection.
Disputes: You acknowledge and agree that we are not responsible for any dispute arising out of your participation in Comfort Posture Buyer Protection.
Governing Law: These Terms and Conditions are governed by Australian law. Any dispute will be resolved under Australian jurisdiction, and the parties agree to submit to the courts of competent jurisdiction.
